Nursery worker, director and company sentenced following death of toddler

Noah Sibanda, aged 14 months, died after being suffocated while nursery staff tried to make him fall asleep. Upon their guilty pleas –
- a nursery worker was sentenced to 3 years 4 months imprisonment for gross negligence manslaughter;
- the company was fined £240,000 for Corporate Manslaughter; and
- the director of the company was sentenced for a health and safety offence (on the basis of neglect) to 6 months imprisonment suspended for 2 years and disqualified from being a company director for 7 years.
The case was prosecuted by John Elvidge KC and Daniel Cordey instructed by CPS Special Crime Division.
