James Robinson successfully defends double decker bus driver

James Robinson successfully defended a double decker bus driver alleged to have driven negligently when a passenger in his 70’s fell from the top of the bus down the stairs sustaining serious injury. The passenger had decided upon a sight seeing trip around London and shortly after boarding the bus with his rucksack and bags fell as the bus was moving off.
Careful consideration of the case of Fletcher v United Counties Omnibus led to the claim being dismissed notwithstanding that the driver expressed his regret for what had happened in his evidence.
