Dan Edwards successfully defends £11.5m claim in High Court

Following an accident at a construction site in April 2007, for which liability had been admitted, the Claimant sought to revisit the settlement agreement concluded in 2010, alleging inter alia fraud, misrepresentation and material GDPR breaches on the part of the Employer’s Insurer.  The Claimant further disputed whether he had capacity to enter into such an agreement, and alleged that there had been a conspiracy between the Insurer and their policy holder.  A claim for £11.5m was brought against the Insurer and a named Senior Claims Adjustor.

Cross applications for strike out (CPR 3.4) and summary judgment (CPR 24.3) were listed before Deputy Master Skinner KC on 23rd September 2025.

Both claims were struck out in their entirety and a costs order obtained in favour of the Defendants.
