Liam O’Brien Secures Acquittal in Medically Complex Sexual Assault Trial

Liam O’Brien recently secured the acquittal of a defendant charged with sexually assaulting his daughter following a trial at the Crown Court.
The defendant, of previous good character, faced an allegation that he had digitally penetrated his then six-year-old daughter.
The prosecution case included expert paediatric evidence said to be supportive of sexual abuse from a consultant paediatrician concerning the presence of a genital abrasion.
After obtaining additional third party material to that initially disclosed and successfully obtaining the leave of the Court to adduce non-defendant bad character evidence, Liam was able to demonstrate that the Complainant had previously made a demonstrably false allegation of physical assault.
Following trial, the jury returned a verdict of not guilty after a relatively short period of deliberation.
