Dan Edwards successfully strikes out claim in the High Court.

A claim brought under the Modern Slavery Act 2015 and seeking damages pursuant to alleged breaches of Articles 3 and 4 of the ECHR has been struck out in the Liverpool District Registry.  Dan Edwards represented both Defendants, The Chief Constable of West Yorkshire Police and The Council of the Borough of Kirklees.  The Claimant, who was acting under an Anonymity Order pursuant to CPR 39.2(4), claimed to be a victim of Human Trafficking.  Despite acknowledging the seriousness of the allegations, after a full hearing, the Court was persuaded that the Claim had been brought out of time, and declined to exercise its discretion to extend the limitation period pursuant to Section 7(5)(b) of the HRA.
