Successful opposition to an application for permission to appeal in the Central London County Court.

Following the termination of a life tenancy upon death, the deceased’s daughter, who had been living at the property in question, sought to be added as a party so they could resist a claim for possession and advance a monetary claim against the landlord. The District Judge at first instance refused that application and granted summary possession.

The deceased’s daughter appealed. On appeal, the landlord was represented by Thomas Parsons-Munn. The appeal court agreed with Thomas’ submission that a money claim against a landlord in this context did not give rise to any proprietary interest capable of defeating the right to possession. 

The appeal was dismissed.
